    The new EU Regulation on Energy Market Integrity and Transparency (REMIT) will come into force later than anticipated as a result of a delay to the regulation being published in the EU’s Official Journal.
    The regulation was due to be published in the journal in November and would become legally binding 20 days afterwards.
    But the European Commission confirmed the delay – which was caused by translation issues – at a seminar held by the Agency for the Cooperation of Energy Regulators (ACER) on 28 November.
    ACER hopes to publish non-binding guidelines on the implementation of REMIT before the end of December, but this timeframe also depends on REMIT’s publication in the Official Journal, the agency said.
    There will be a short public consultation period before the publication of the guidelines.
    A spokesperson from the Commission would not say when the regulation was likely to be published when questioned by ICIS Heren.
    ACER’s director Alberto Pototschnig emphasised at the seminar that the guidelines are aimed at helping national regulators with the implementation of REMIT in coordination with ACER.
    The guidelines, which will be an evolving document, will at this stage focus on defining terminology, for example, it will look at what will be considered insider trading (see EDEM/ESGM 24 November 2011).

    Intarzierea intrarii in vigoare a noilor reglementari UE privind transparenta

    Noul Regulament UE privind Integritatea si Transparenta Pietei de Energie (REMIT) va intra in vigoare mai tarziu decat s-a anticipat, ca urmare a unei intarzieri aparute la publicarea acestui regulament in Jurnalul Oficial al Uniunii Europene.
    Era prevazut ca Regulamentul sa fie publicat in Jurnalul UE in luna noiembrie, urmand sa devina obligatoriu din punct de vedere juridic la 20 zile dupa punblicare.
    Dar Comisia Europeana a confirmat întarzierea - care a fost cauzata de probleme de traducere - la un seminar organizat pe 28 noiembrie de catre Agentia pentru Cooperarea Autoritatilor de Reglementare din domeniul Energiei (ACER).
    ACER spera sa publice, inainte de sfarsitul lunii decembrie, un document care va contine orientari, fara caracter obligatoriu, privind implementarea REMIT, dar si respectarea acestui termen depinde de data publicarii REMIT in Jurnalul Oficial al UE, a declarat agentia.
    Inainte de publicarea acestor orientari, va exista o scurta perioada de consultare publica.
    Un purtator de cuvant din partea Comisiei nu a putut sa spuna, cand a fost intrebat de ICIS Heren, care va fi data probabila a publicarii regulamentului.
    Directorul ACER, Alberto Pototschnig a subliniat, la seminarul mentionat, ca orientarile care urmeaza sa fie emise de aceasta agentie sunt menite sa ajute autoritatile nationale de reglementare la implementarea REMIT, in coordonare cu ACER.
    Documentul continand aceste orientari, care va fi un document in continua evolutie, se va concentra in aceasta etapa pe definirea terminologiei, de exemplu, se va referi in detaliu asupra continutului termenului de „tranzactii bazate pe informatii privilegiate (insider trading)” (a se vedea EDEM / ESGM 24 noiembrie 2011).
